SECTION A: GENERAL RELEASE
A.1. I am of legal age (18 yrs or over) and I grant permission to Snapxpressions Photography (photographer) to use my images in print or digital form on the photographer's blog, website, social media account, printed sample items for studio, advertisements and promotions. While reasonable effort will be made to properly credit images appearing in print and digital format on other platforms, it is understood that my name may not be included/credited in every form of publication.
A.2. I understand that the photographer cannot be held responsible for the mis-use or mis-credit of my images by others once the images have been published on-line. I further waive any and all rights to review or approve the images prior to their print or digital release for the photographer's use.
A.3. I understand that I am able to use the images of myself, for my own portfolio, personal print, and/or social media accounts, but only with proper credit given to the photographer. Releasing the images to 3rd party or businesses without consent from the photographers is prohibited.
A.4. I understand that I am not to alter the images in any way other than to crop for social media purposes. Filters and re-edits are not permitted. I understand that I will not be held liable for the mis-use or mis-credit of the photographer's work by others once the images have been placed online in digital format by me, as long as I have done my part in properly crediting the photographers and any/all involved parties (wardrobe stylists, photographers, makeup artists, hair stylists, venue, jewelers, etc etc).
Unless Privacy option is elected (see Section) D, the general release will apply.
SECTION B: MODEL ENGAGEMENT AGREEMENT
B.1. The model understands and agrees that there will be no compensation for time, talent, travel, services, clothing, props, equipment, or use of location associated with the photo session unless agreed in contract in advance.
B.2 I understand that as a model that images will be released at the photographer's discretion to protect the quality of work and to achieve the purpose of the photo session. The photographer will release selected good images at the request of the model as a trade for service.
B.3 If at any time I would like to revoke the use of my images by the photographer, I understand that I am responsible to pay the full cost for the session fee and all other related expenses to the making of the image such has HMUA fee, travel fee, location fee etc. The cost of the photo session will be disclosed prior to the event. I understand that the photographer will remove all of my images from their website/blog/social media, but that the photographer cannot be responsible for removing my images that may have been featured on a third party's website.
B.3. I understand that, if I am model/client represented by a third party agency or independent agent, I am solely responsible for making this information known to the photographer prior to shooting. The agency will request consent to publish my images by email or by writing. I also understand that the copyright of images remain with the photographer and I am not allowed to profit or sell the images to any third party.
SECTION C: BOUDOIR OR NUDITY
C.1. Poses and Nudity Limit of Liability. The client/model understands that the photographer(s) will photograph/Video the model clothed, partially clothed, nude and/or partially nude. The model will be positioned in many poses or a comfort level they may not be comfortable with in order to capture the best image the photographer(s) believes possible. The model agrees and understands that it’s the model's responsibility to identify to the photographer(s) face to face the model’s personal likes, dislikes of body characteristics, comfortable nudity or partial nudity level, poses and their comfort level verbally before photography / video shoot starts.
C.2. The model/client understands that at any time the model can stop the shoot or change their comfort level. The model understands that it is the model’s responsibility to inform the photographer(s) verbally when they do. In order for the photographer to retain control over the creative aspect of the session the model understands and agrees to allow the photographer(s) the right to adjust clothing during the shoot or the lack thereof.
C.3. The model/client hereby releases the photographer and all associates representatives and assigns from any and all claims, actions, demands, suits, liabilities, damages, expenses, and obligations of any kind arising from accidental touching of model during a shoot. The model understands that poses can be physically strenuous on the body and injury from being in a pose or transitioning to or from a pose could cause bodily injury. The model agrees not to hold the photographer liable in any way or seek compensation for any injuries that may occur during a shoot, this includes but not limited to poses, instructions from the photographer(s), positioning or adjustment of clothing or props by photographer(s) physically or verbal, use of furniture or facilities.
SECTION D: PRIVACY OF DIGITAL RELEASE OF IMAGES.
D.1. The model/client agrees that MODEL RELEASE is mandatory for the release of digital images regardless of the privacy type.
D.2. The model/client may choose a privacy (personal view) option when copies of images are requested. This means that the model/client and photographer and all other parties involved in creation of the images are not allowed to post, print, email, transfer, copy any digital or print images to media without approval of all parties. For private photos, proofing will be done in person only. Digital images will not be available if privacy is option is selected. Prints can be made available for purchase from the creator of the image at additional cost.
D.3. Written Permission to publish private images. A written request and identification of file must be communicated if the client/model needing to use the images other than for personal viewing purpose.
D.4. It is the responsibility of the client/model to secure the media/files containing the images upon release. Additional processing fees will be required to retrieve previously released images if still available.
D.5. The photographer/creator of images are allowed to delete, destroy or archive the images without approval in any manner possible as deemed appropriate and reasonable. Photographers are not liable for loss of data due to unperceived situation such as theft, natural disaster or any unintentional manner. Photographer/creator understands the responsibilities set by this release.
D.6. Publishing without notice. The model/client understands that if the images were published without prior notice to the photographer and without approval, the PRIVACY OPTION will be void and the default MODEL RELEASE will apply to all images. (Refer to sections A and B)
